Man Sues Wife For Falsifying Pregnancy

A man in Dubai has sued wife for Dh2 million for falsely claiming she was pregnant.

According to the National.AE, the Jordanian was married to his wife, of the same nationality, for 11 years without knowing she was infertile, he said. A few years into their marriage he planned to marry another woman, and his wife left for Jordan, the case files said. Before the second marriage, his wife sent him medical reports from Jordan that showed she was pregnant, so he cancelled his marriage plans and arranged for his first wife to return to the UAE. Soon after, she told him she had suffered a miscarriage.

They continued to live together and she continued to claim she was pregnant and having miscarriages, until the husband decided to contact her gynaecologist in Jordan, who gave him her medical reports. He discovered that she had undergone fertility tests before their marriage and knew she was infertile. He filed a lawsuit, accusing her of forging medical reports.

She confessed to prosecutors that eight years ago she forged the documents with her sister, a hospital worker. However, she was cleared of the charges as forgery cases expire after five years.

The husband then sued her for damages at the Civil Court and claimed he suffered psychological and financial damage because of her false pregnancy claims. He requested Dh2 million in compensation. He also demanded she pay back the money he spent for her treatment.

The First Instance and Appeals Court rejected the lawsuit because it was clear that he was aware of her infertility because he paid for treatment. The court also said he did not present the bills for the alleged treatment. He was also unable to prove his depression was caused by his wife’s infertility.
