Court Denies Convicted Actress, Ibinabo Fiberesima’s Application for Bail

The Nollywood actress and mum who was sentenced to 5 years in prison last week Friday for killing a medical doctor in a car accident in 2005 (read here) was denied bail yesterday.

The ex-beauty queen and Actors’ Guild of Nigeria (AGN) president had appealed that she was recuperating from breast surgery and that staying in prison would endanger her life.

According to the Nation, a three-man-panel presided over by Justice Ndukwe-Anyanwu stated that the actress cannot be granted bail as a result of failure to attach copies of last Friday’s judgment, which affirmed the 5-year jail sentence imposed on her by a Lagos High Court.

Justice Anyanwu added that the only option available was to strike out the appeal or adjourn the case. Ibinabo Fiberesima’s lawyer subsequently sought for an adjournment and the case was adjourned till April 7th, 2016.

Meanwhile, fresh details about her breast surgery have emerged. A six-paragraph affidavit of urgency deposed by Victor Eden, stated that Ibinabo was recovering from surgery as a tumour was removed from her breast, and she needed constant monitoring by her doctors.

“Her wound has not fully healed and as such, she is afraid that her continued stay in the prison may endanger her life as she will not have access to special medical attention,” Eden said.

He added that it would be in the interest of justice and her health and safety to admit Ibinabo Fiberesima to bail pending the determination of her appeal before the Supreme Court.
